General Terms and Conditions

The general terms and conditions of the online store ipdfashionstore.com are drawn up in accordance with the Consumer Protection Act (ZVPot), with the recommendations of the Chamber of Commerce and Industry and international e-business codes. The general terms and conditions of the online store determine the conditions of purchase and sale of products carried out by the company RECTOR GROUP, distribucija, d.o.o., Cesta na brdo 55, 1000 Ljubljana (hereinafter the provider). The online store ipdafashionstore.com (hereinafter the online store) is an information system intended for the presentation and sale of products to users. The online store is managed by RECTOR GROUP d.o.o., PE IPD FASHION STORE. An online store user is a person who uses our system, i.e. a customer in the ipdfashionstore.com online store.

The provider and the buyer regulate their mutual obligations for purchases through the online store with these general terms and conditions. The general terms and conditions deal with the operation of the online store, the user's rights and the business relationship between the provider and the customer.

General

By using the online store, you agree to all the conditions listed below. The provider endeavors that these pages include only accurate and authentic information. However, this information can be changed in any way without prior notice, for which the provider assumes no responsibility for the content and errors that may occur. The provider is not responsible if your hardware malfunctions due to anything (errors, viruses). The provider may change these conditions without prior notice.

Payment methods

The provider allows the following payment methods:

  • Cash on delivery - you pay the courier upon delivery of the package. Payment to the courier can be made in cash or with a debit / credit card (for payments with payment cards, a commission is charged in accordance with the general conditions of the GLS delivery service)
  • Payment by credit card - you can also pay by credit card (Visa, MasterCard). Credit card payment is processed by a specialist company, Shopify
  • Payment with PayPal account

 Until full payment of the products from an individual order, the ordered products remain the property of the provider. The provider issues an invoice on a permanent medium (paper) with itemized costs. The invoice will be sent to the customer inside the package with the ordered products.

Prices in the online store

All prices are in EUR and include 22% VAT.  We reserve the right to change prices, unless otherwise stated (for example promotions and special discounts). Prices are valid at the time of placing the order and do not have a predetermined validity. The prices are valid in case of payment with the above-mentioned payment methods and under the above-mentioned conditions. The listed prices apply only to purchases in the ipdfashionstore.com online store and may differ from prices at other points of sale.

Delivery method and delivery costs

The provider offers the following delivery methods: 

  • Package delivery with the GLS delivery service - we will send a package with the ordered products and an invoice to the registered delivery address.
  • Personal collection at IPD Fashion Store, Cesta Ljubljanske brigade 33 and Jurčkova cesta 223, 1000 Ljubljana

 Method of delivery or pick-up of the goods is selected during the ordering process. We deliver goods that are in stock within 1 - 3 days. If the goods are not in stock, the delivery time can be extended indefinitely (usually up to 30 days).

After placing the order, the web administrator may call you to inform you of the exact delivery date.

The cost of postage is €4.90 including VAT.

Purchase process

The customer first selects the products and the quantity of individual products and adds them to the basket. After entering the products in the basket, he continues the purchase process by clicking on the "complete order" button, where he performs all the necessary steps to complete the purchase. In the last step, by clicking on the button "pay now" or "complete order" makes a purchase in the online store ipdfashionstore.com. After completing the purchase, the buyer receives an email containing a proforma invoice for payment of the ordered products.

The right to withdraw from the purchase, return the goods

The consumer (the above applies exclusively to natural persons who acquire goods for purposes outside of their commercial activity) has the right to notify the company (e-mail address: info@ipdfashionstore.com) within 14 days of receiving the goods that they withdraw from the contract without having to give a reason for their decision. The deadline starts counting one day after the date of collection. The only cost charged to the consumer in connection with withdrawal from the contract is the cost of returning the goods (which, in the case of shipping, is charged according to the price list of the delivery service and depends on whether it is a shipment/package/cargo). The goods must be returned to the seller no later than 14 days after the notification of withdrawal from the contract (purchase).

In the case of returning the product within 14 days of receipt (withdrawal from the contract), the buyer has the right to a refund of the entire purchase price for the product, as well as the cost of delivery, if this was charged at the time of purchase. The return of postage is made in the amount of the cheapest standard delivery option that we offer. The cost of returning the product (shipping it back to us) is covered by the buyer. 

If delivery was free at the time of purchase (e.g. for an amount above a certain threshold), we only return the amount of the product upon return. 

If the buyer does not accept the package or refuses it upon acceptance, this is considered a unilateral withdrawal from the contract. In such a case, the buyer is only entitled to a refund of the purchase price for the product (if it was prepaid), but is not entitled to a refund of the delivery cost, nor is he entitled to the cost of returning the package back to us, which may be deducted from the refund amount. A refund of postage is not possible if the product is returned after the 14-day period or if the product is not returned in perfect, unused condition and in the original packaging.

The consumer does not have the right to withdraw from the contract, in the case of contracts the subject of which are goods that have been manufactured according to the consumer's precise instructions, that have been adapted to his personal needs, that due to their nature are not suitable for return, that are perishable or that have already expired.

The consumer must return the product to the seller undamaged and in the same quantity, unless the product is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The consumer may not use the products unhindered until the withdrawal from the contract. The buyer bears the costs of returning the goods.

The consumer may inspect and test the products to the extent necessary to determine the actual condition. The consumer is responsible for the reduction in the value of the goods, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods.

The consumer may not use the goods unhindered until withdrawal from the contract. The consumer may inspect and test the goods to the extent necessary to determine the actual condition.

Payments made will be refunded as soon as possible, but no later than within 14 days of receiving the notice of withdrawal from the contract. The company returns the received payments to the consumer with the same means of payment that the consumer used, unless the consumer has explicitly requested the use of another means of payment and the consumer bears no costs as a result.

The right to a refund of the purchase price, warranty, material defects and improperly performed services are more precisely regulated by the provisions of the Consumer Protection Act.

Factual errors

The consumer can assert his rights from a material defect if he informs the seller about the defect within two months from the day the defect was discovered. In the error notification, the consumer must describe the error in more detail and allow the seller to inspect the item.

The consumer can notify the seller of the defect personally, for which the seller must issue a certificate, or send it to the store where the item was purchased, or to the representative of the seller with whom he concluded the contract. The seller is not responsible for material defects in the goods that become apparent after two years have passed since the item was delivered.

A defect in the goods is considered to have already existed at the time of delivery if it appears within six months of delivery. The consumer's rights from the second paragraph expire after the expiration of two years from the day on which he informed the seller about the factual error.

The consumer, who has correctly informed the seller about the defect, has the right to request the seller to: eliminate the defect in the goods or replace the defective goods with new, flawless goods or return the amount paid.

If the existence of a defect in the goods or an irregularity in the service provided is not in dispute, the company must comply with the consumer's request from articles 37.c and 38 of the ZVPOT as soon as possible, but no later than within eight days.

The company must respond to the consumer's request in writing no later than eight days after receiving it, if the existence of a defect in the goods or an irregularity in the service provided is disputed.

In accordance with Article 32 of the Act on Out-of-Court Resolution of Consumer Disputes (ZIsRPS), we inform consumers that we do not recognize any provider of out-of-court consumer dispute resolution (IRPS) as competent to resolve a consumer dispute that a consumer can initiate in accordance with ZIsRPS. Damage to the product

The buyer is obliged to carefully inspect the packaging and its contents when accepting the product. In case of damage to the product, the buyer is obliged to notify the delivery person immediately of the damage. The buyer is obliged together with the postal worker or to draw up an official record for the delivery person, and to fill out the section on the condition of the packaging and the product with particular care. The buyer will hand over the damaged product, which will be sent to the sender's address together with the official record at the expense of RECTOR GROUP d.o.o., PE IPD FASHION STORE. After receiving the damaged product, we will send the customer a new product as soon as possible.

In the event that the buyer notices damage to the product after delivery, but within 30 days after delivery, report the damage to info@ipdfashionstore.com. The condition for reporting product damage within 30 days after delivery is that the packaging is kept, on the basis of which it is determined where or how the injury occurred. It is also desirable that the damage is recorded with a camera and photos sent to info@ipdfashionstore.com. All subsequent product damage complaints are taken into account by carriers only in exceptional cases and our company cannot resolve them on their behalf.

Security of purchase

A given purchase order constitutes the conclusion of a sales contract. This sales contract or purchase order is stored with the provider and can be obtained by the buyer upon written request at any time within 5 years of the order being placed. We carefully protect customer data obtained from our online store. We guarantee that we will use the collected data exclusively to carry out purchases and improve the functioning of the website. Before delivering the goods, the provider has the right to contact the customer by phone or e-mail in order to verify the provided contact information. In the event that the provider is unable to contact the customer based on the information provided, the provider may consider the purchase order as void.

Non-receipt of package

According to the Code of Obligations, the buyer is obliged to take over the ordered package and pay the ransom. If the buyer does not accept the package, this action causes financial damage to the company. We urge all potential buyers to check their financial situation before placing an order and not to order in the online store if they are unable to pay. In the case of fraudulent orders, the customer's IP address will be submitted for further processing as abuse.

Disclaimer

The provider makes every effort to ensure the consistency and up-to-dateness of the data published on its website. Nevertheless, the characteristics of the products, their stock and price can change so quickly that the provider fails to correct the information on the website in time. In such a case, the provider will inform the customer about the changes and enable him to cancel the order or exchange the ordered item. There may be deviations in color shades from the product photos.

Within five working days, the provider must confirm that it has received the complaint, notify the user or to the buyer, how long it will take to process it, and to keep him informed about the progress of the process at all times. The provider will make every effort to amicably resolve any disputes.
